Certificate Provider

At SKY Social Work, our experienced and registered Independent Social Workers are qualified to act as Certificate Providers for Lasting Powers of Attorney (LPA). This role involves confirming that the individual creating the LPA understands the nature and implications of the document, and that they are doing so voluntarily—free from pressure or undue influence.

As impartial professionals, we ensure this important safeguard is carried out with clarity, sensitivity, and respect for the individual’s rights and wishes.

Our Independent Social Workers at SKY Social Work are qualified to act as Certificate Providers for Lasting Powers of Attorney (LPA). In this role, we confirm that the individual (the Donor) fully understands the significance of the LPA, has the mental capacity to make the decision, and is doing so voluntarily—free from any pressure or undue influence.

We also ensure there is no evidence of fraud or any other concerns that could affect the validity of the LPA. As part of this service and cost, we provide a brief summary report, offering added reassurance and transparency.

Who can act as a Certificate Provider for a Lasting Power of Attorney?

To act as a Certificate Provider for a Lasting Power of Attorney (LPA), certain eligibility criteria must be met. The role must be filled by an impartial individual who can confirm that the Donor:

  • Understands the nature and significance of the LPA,

  • Has the mental capacity to make the decision, and

  • Is acting voluntarily, without pressure or undue influence.

To protect against conflicts of interest, the following individuals are not eligible to act as a Certificate Provider:

  • Family members or extended family of the Donor,

  • The Donor’s business partner, director, or employee,

  • Anyone appointed as an Attorney in the current or previous LPAs,

  • Owners, directors, employees of a care home where the Donor resides, or their relatives,

  • Anyone associated with a trust corporation appointed as an Attorney for financial matters.

These safeguards are in place to ensure the integrity of the LPA process and to protect the Donor’s rights. At SKY Social Work, all our Mental Capacity Assessors are experienced, registered social workers—qualified to act as impartial and trustworthy Certificate Providers.
